Shane called me on 5/8/15 and asked if I could move him and his wife from nelson BC to Summerland BC.
I worked out a quote ov $1645.00 + gst
He said "To much" that he would pay $1500 cash. work was slow so felt I could do it for that and back work the tax in.
The list he gave me was, 2 bed room apt. with 2 beds, 2 couches, 2 dressers, and a love seat.
Light load I figured . . . no problem.
I arrived to 461 West Richards, Nelson, location to load and met with Liz (Elizabeth Simmons) Shane's wife . . . and she proceeded to point out the same items that were on my list . . . here is my Helpers account.
When we went up stairs there were 3 bed rooms and the central one was filled wall to wall to ceiling, and Liz promptly said nothing from this room.
So We loaded the furniture as directed and a few boxes, and when I asked about certain largish items I was told no that she only wanted the large items loaded and the rest they would take in the two SUV's.
Got to Summerland at 9510 Quinpool rd. and the house was open so unloaded the contents.
when I went to Shane's restaurant Kraut Haven, at which point he said he didn't have that kind ov cash on hand and didn't have the check book with him, so would do a bank transfer Monday.
This was not Good is what I thought .
Monday came and the transfer didn't so I contacted him and he said he would not pay as I had only moved 1/2 ov his stuff.
I initiated a small Claims in court and . . . he countered with a counter suit . . stating that he had made 7 trips back to nelson to get his stuff and wanted $900 from me.
Well I have proof he never did that.
We were scheduled to meet in a settlement conference . . . and he never showed, but phoned and the Judge said that was only allowed if prearranged and approved by the Judge . . . but we would proceed.
No settlement could be reached . . . so as the judge and court clerk were looking for a date . . .
Shane . . not able to here silence said "Well it doesn't mater if he gets a judgment I will not pay him anyways" at which point the Judge repeatedly told him to cease and desist as he was uttering a threat in front ov a judge.
The trial date came and Shane never showed up.
Through this whole Time liz was a party to this . . and just as big a Con artist as Shane . . and I should have made her a defendant as well but thought she would better serve me as a witness, then she would have been outside the court room as evidence was presented . . . and I could then cross her in a way to get the truth out ov her.
